The Kavanaugh Allegation Process Is A Miscarriage Of Justice For Everyone

After the Senate Judiciary Committee hearings for Supreme Court nominee Brett Kavanaugh concluded, Sen. Dianne Feinstein, D-Calif., revealed that for six weeks she’d hidden a claim he’d sexually assaulted someone.

Much of the media coverage has focused on how this is good for Democrats and bad for Republicans. While that’s interesting (if debatable), if you take sexual assault seriously, if you take due process seriously, it’s far more important to discuss whether this is good for the republic itself.

Even if Sen. Feinstein had handled the situation properly, and not as a political cudgel, the Senate is still an inappropriate place to litigate the claim. A star chamber full of grandstanding senators on both sides will not elucidate what happened four decades ago, when all people involved were minors, and the accuser is unclear on the details.

While the media and other Democratic institutions are currently disdainful of due process for sex assault claims, in America, we don’t say that murky allegations are the same as guilty convictions. We don’t even say that clear allegations are the same as guilty convictions. People have a constitutional right to face their accuser, and cases must be proven beyond the partisan court of punditry. If Kavanaugh, a husband and father of young girls, is an attempted rapist, the appropriate place to make that case is in a courtroom.

Society should encourage the use of legal proceedings where the accuser can get a measure of justice for wrongdoing and the accused faces a jury of peers instead of a jury of partisans, where representation can cross-examine witnesses. A society that instead encourages litigating murky claims of sexual assault in the kangaroo courts of the media and Senate hearings is an unhealthy society.

It is tough to lose elections, and deal with the consequences of losing elections. Much of Washington, D.C. — in both parties, to be honest — has refused to accept the previous election. Since his surprising victory, elements of the Resistance have, well, resisted everything Trump does. When Kavanaugh was nominated, many Democrats announced that they would never vote for him and would do whatever it took to delay and fight his nomination.

Feinstein’s behavior is not the behavior of someone who seeks justice for a victim of sex assault. It is the behavior of someone who seeks to prevent a Republican president from filling a vacancy with a qualified candidate. The American people have a right to elect a president who fills vacancies on the court.

It is one thing to keep a precedent of not filling vacancies in the last few months of a presidency. It is entirely another to establish a precedent that unverifiable allegations can indefinitely prevent the filling of a seat.

The American people elected Donald Trump to fill these vacancies. Delaying tactics that are not about seeking or obtaining justice should not be rewarded, particularly when they involve the destruction of reputations and careers without sufficient compelling evidence.

What is so "sick" about your statement is that you don't understand the vast difference between the two events.

Blasey-Ford has never accused Kavanaugh of Rape, she accused him of "Sexual Harassment" there is a BIG difference.

An accusation of sexual assault supposedly perpetrated by Supreme Court nominee Brett Kavanaugh — The “last-minute revelation,” which we believe was actually part of a well-orchestrated obstructionist strategy formulated in June by Sen. Dianne Feinstein (D-CA) — may best be described as evil genius.

While the allegation against Kavanaugh — from 35 years ago when they were both teenagers — is serious, it’s also quite dubious. Indeed, even the leftist San Francisco Chronicle has questioned the timing of Feinstein’s charade, and its presumption of “guilty until proven innocent.”

Chronicle editors note, “Feinstein’s treatment of a more than 3-decade-old sexual assault allegation against Supreme Court nominee Brett Kavanaugh was unfair all around. It was unfair to Kavanaugh, unfair to his accuser and unfair to Feinstein’s colleagues — Democrats & Republicans alike — on the Senate Judiciary Committee.”

Feinstein and her fellow Democrats sat on this allegation since July, not asking Kavanaugh even one question about it during the three days of hearings, nor during their closed-door questioning. In other words, there is no question that the timing is a politically calculated play by the Democrats.

Make no mistake, Democrats’ calls to immediately halt the confirmation vote on Kavanaugh in order to investigate this allegation is an assault on the Constitution. The foundational concept of “innocent until proven guilty” is what has made the U.S. justice system the envy of the world.

Democrats are pushing the dangerously flawed concept of assuming guilt based solely on the seriousness of the accusation and then demanding that the accused prove his innocence. Unfortunately, with a friendly mainstream media backing them, they've effectively 'win-win' weaponized the #MeToo movement against Kavanaugh.

Democrats can and will use it to rail against the GOP in the midterms if the Senate votes to confirm OR the vote gets drawn out, either way. In fact, should the vote be delayed until after the midterms, and should Democrats win a Senate majority, their argument will be the Kavanaugh vote must be delayed until the new Senate is seated because “the people have spoken.”

In the end, this recent dirty play by Democrats has made one thing patently obvious: The Washington swamp is far from drained.

You are wrong. Nowhere did I use the word rape and I have not seen the word used in any of the Kavenaugh reports, so I don't know what the hell you are on about. If someone puts their hand over your mouth to stop you from screaming while they're trying to rip your clothes off as Ford alleges Kav did, that is SEXUAL ASSAULT. A little more serious than sexual harassment wouldn't you agree? Penis penetration does not need to happen for sexual assault to occur. :roll: :roll: :roll: :roll:

Third Named Witness Rejects Kavanaugh’s Accuser’s Allegations

In written testimony sent to the Senate Judiciary Committee, a third named witness has rejected the allegations made by Judge Kavanaugh’s accuser. Having been asked by a Senate staffer to comment on the charges advanced against the nominee, a lawyer for Leland Ingham Keyser wrote:

Simply put, Ms. Keyser does not know Mr. Kavanaugh and she has no recollection of ever being at a party or gathering where he was present, with, or without, Dr. Ford.

Under 18 U.S.C § 1001, letters to the Judiciary Committee are subject to criminal penalty if false.

Ms. Keyer, whom CNN confirms is “a lifelong friend of Ford’s,” is the third named witness to deny any knowledge of the allegations. The other two, Mark Judge and Patrick Smyth, issued written statements to that effect earlier in the week. Thus far, nobody has backed up the account advanced by Kavanaugh’s accuser, while Kavanaugh and three other named witnesses have rejected it outright.

Dr. Christine Blasey Ford added Michael Bromwich, a former federal prosecutor and Department of Justice inspector general, to her legal team Saturday, as she prepares to give information to the Senate Judiciary Committee about her alleged hostile encounter with Supreme Court nominee Brett Kavanaugh.

The addition of Bromwich further burnishes the progressive credentials of the Blasey Ford roster. Politico reported that Democratic public relations guru Ricki Seidman will advise Blasey Ford in the coming days, while CNN revealed her lead attorneys organized a fundraiser for Wisconsin Democratic Sen. Bromwich brings serious weight to a legal team with deep expertise in legal issues arising from sexual misconduct. Bromwich, who resigned his position in private practice Saturday, was a prosecutor in the Iran Contra affair and became the Justice Department’s inspector general during the Clinton administration. CNN's "reveal" is silent on how inquiries didn't come from them, or any like-minded media favorable to the cause - This cash-in was foiled but it's OK, there's more than one way to make political hay out of the Dem & MSM circus

Due process for alleged sexual assault? Like HELL! Dragging the accused through the streets? That's the ticket - It's all about entrusting responsibility to the right person. Gotta hand it to Sen. Feinstein. She knew what to do.

I would say, we are ripe, for what ever the planned "Take Over " is. I would think Pain and Poverty could be the things that finally bring the people together, mutual loss, does get attention. But of course a little late for correction.................

You forgot the "Tar and Feathers"

Tarring and feathering is a form of public torture and humiliation used to enforce unofficial justice or revenge. It was used in feudal Europe and its colonies in the early modern period, as well as the early American frontier, mostly as a type of mob vengeance. Awareness of tarring and feathering in popular culture remains.

“Fox News Sunday” host Chris Wallace said Sunday that all 10 Senate Judiciary Committee Democrats refused invitations to appear on his show — for the second week in a row — to discuss the allegations made by Dr. Christine Blasey Ford against Supreme Court nominee Brett Kavanaugh.

Wallace spoke to Republican Sen. Lindsey Graham about the ongoing back and forth between the attorneys for Blasey Ford and Committee Chairman Chuck Grassley, who most recently claimed he felt like he was “playing 2nd trombone in the judiciary orchestra.”

But just before Wallace introduced Graham, he took a swing at the 10 Democrats on that committee who had opted not to appear on his program.

“We should note for the second week in a row we invited all 10 committee Democrats to join us, and for the second week, none of them accepted,” he said. “And with that, Senator Graham, welcome back to ‘Fox News Sunday.'”

Graham responded with a laugh, saying, “You must be mean.”

“Or they don’t want to talk …” Wallace quipped.

New Kavanaugh Accuser Alleges Sexual Misconduct at Yale Party


Senate Democrats are probing a new sexual-misconduct allegation against Supreme Court nominee Brett Kavanaugh, The New Yorker reports.

The alleged incident occurred while Kavanaugh was a freshman at Yale University, and it is reportedly being investigated by at least two Democratic offices on Capitol Hill. Republican staffers were reportedly made aware of the allegation last week.

“This is another serious, credible, and disturbing allegation against Brett Kavanagh. It should be fully investigated,” Sen. Mazie Hirono (D-HI) told the publication.

The woman, 53-year-old Deborah Ramirez, alleges that Kavanaugh “thrust his penis in her face” during a party. She said she pushed him away after his penis touched her. She claimed Kavanaugh was laughing, adding: “I can still see his face, and his hips coming forward, like when you pull up your pants.”

Ramirez was initially reluctant to go public, she says, citing gaps in her memory due to the fact that she was inebriated that night. But according to The New Yorker, she spent six days “carefully assessing her memories and consulting with her attorney” and eventually felt comfortable with coming forward. Now she wants the FBI to investigate the alleged incident.

“I wasn’t going to touch a penis until I was married,” Ramirez said. “I was embarrassed and ashamed and humiliated.”

Kavanaugh denies the allegation.

The White House is standing by Kavanaugh, as he prepares to testify in front of the Senate Judiciary Committee on Thursday about a separate allegation of sexual assault.

“This 35-year-old, uncorroborated claim is the latest in a coordinated smear campaign by the Democrats designed to tear down a good man,” said spokeswoman Kerri Kupec. “This claim is denied by all who were said to be present and is wholly inconsistent with what many women and men who knew Judge Kavanaugh at the time in college say. The White House stands firmly behind Judge Kavanaugh.”

The New Yorker spoke with one of Ramirez’s classmates, who preferred not to be identified and said he was “100 percent sure” that another student informed him of the alleged incident shortly afterward, and that the other student named Kavanaugh as the individual who exposed himself to Ramirez. “I’ve known this all along,” the classmate said. “It’s been on my mind all these years when his name came up. It was a big deal.”

But two male classmates identified by Ramirez as having “egged on” Kavanaugh said they have no memory of the party in question.

Attorney Michael Avenatti, who represents Stormy Daniels, wrote on Twitter on Sunday night that he represents “a woman with credible information regarding Judge Kavanaugh and Mark Judge,” the man who was allegedly present during an incident detailed by Christine Blasey Ford. Avenatti later said Ramirez is not his client.

What you are witnessing in the here and now is the death of a Representive Republic. The Democrats, do not care about truth or the law (Constitution)that has held our country together for over 200 years. If Kavanaugh is allowed to be put down, without being able to defend himself, without direct contact with his "Accusor(s), the laws of the land have just been drastically changed, into a common Democracy of the "Old Wild West" Hang 'em Now, Ask Questions Later. We will have winners and losers, but never again will we be very sure of WHAT was won and what was lost. Hitler did the same thing, Jews an Gypsies where to be eradicated , same thing, get rid of Republicans and white males. I SEE NO DIFFERENCE. In the end the sanctimonious self-righteous, morally corrupt will rule with permission, yours if you are a Democrat.

The shocking allegations made by Deborah Ramirez against Brett Kavanaugh fell apart in record time, but that hasn't stopped Democrats from seizing on these new allegations to... you guessed it, call for a delay. Recent revelations suggest this was the Democrats' plan all along — that this whole bogus story was concocted by Senate Democrats as Christine Blasey Ford's story fell apart last week.

Check out what Ronan Farrow said on Good Morning America earlier today:

STEPHANOPOULOS: Why did [Deborah Ramirez] come forward?

FARROW: She came forward because Senate Democrats came looking for this claim. She did not flag this. This came to the attention of people on the Hill independently, and it has cornered her into an awkward position. She said, point-blank, I don’t want to ruin anyone’s life, but she feels this is a serious claim. She considers her own memories credible and she felt it was important to tell her own story before others did for her.

Got that? Democrats sought her out. Democrats were obviously free to investigate, but according to Senate Judiciary Committee Chairman Chuck Grassley, Democrats withheld this info from Republicans on the Senate Judiciary Committee.

The spokesperson in a statement slammed Democrats for "withholding information" regarding the allegations.

Republicans denied Obama's Supreme Court nomination a year before Obama's term ended. Do you think that was fair? Or do you subscribe to "win at any cost" as long as it's a win for the Republicans? I don't expect an answer as there isn't one that could justify it. But that's why the Republican's have been nicknamed "Rethuglican's" What's good for the goose is good for the gander. Nice to see the Democrats flat out fight this bunch of thugs.

Republicans have always been a sleazy lot but now they have a leader that is the biggest and most obvious sleaze bag in the world.
