Change Nobody Believes In

A bill so reckless that it has to be rammed through on a partisan vote on Christmas eve.


And tidings of comfort and joy from Harry Reid too. The Senate Majority Leader has decided that the last few days before Christmas are the opportune moment for a narrow majority of Democrats to stuff ObamaCare through the Senate to meet an arbitrary White House deadline. Barring some extraordinary reversal, it now seems as if they have the 60 votes they need to jump off this cliff, with one-seventh of the economy in tow.

Mr. Obama promised a new era of transparent good government, yet on Saturday morning Mr. Reid threw out the 2,100-page bill that the world's greatest deliberative body spent just 17 days debating and replaced it with a new "manager's amendment" that was stapled together in covert partisan negotiations. Democrats are barely even bothering to pretend to care what's in it, not that any Senator had the chance to digest it in the 38 hours before the first cloture vote at 1 a.m. this morning. After procedural motions that allow for no amendments, the final vote could come at 9 p.m. on December 24.

Even in World War I there was a Christmas truce.

The rushed, secretive way that a bill this destructive and unpopular is being forced on the country shows that "reform" has devolved into the raw exercise of political power for the single purpose of permanently expanding the American entitlement state. An increasing roll of leaders in health care and business are looking on aghast at a bill that is so large and convoluted that no one can truly understand it, as Finance Chairman Max Baucus admitted on the floor last week. The only goal is to ram it into law while the political window is still open, and clean up the mess later.

• Health costs. From the outset, the White House's core claim was that reform would reduce health costs for individuals and businesses, and they're sticking to that story. "Anyone who says otherwise simply hasn't read the bills," Mr. Obama said over the weekend. This is so utterly disingenuous that we doubt the President really believes it.

The best and most rigorous cost analysis was recently released by the insurer WellPoint, which mined its actuarial data in various regional markets to model the Senate bill. WellPoint found that a healthy 25-year-old in Milwaukee buying coverage on the individual market will see his costs rise by 178%. A small business based in Richmond with eight employees in average health will see a 23% increase. Insurance costs for a 40-year-old family with two kids living in Indianapolis will pay 106% more. And on and on.

These increases are solely the result of ObamaCare—above and far beyond the status quo—because its strict restrictions on underwriting and risk-pooling would distort insurance markets. All but a handful of states have rejected regulations like "community rating" because they encourage younger and healthier buyers to wait until they need expensive care, increasing costs for everyone. Benefits and pricing will now be determined by politics.

As for the White House's line about cutting costs by eliminating supposed "waste," even Victor Fuchs, an eminent economist generally supportive of ObamaCare, warned last week that these political theories are overly simplistic. "The oft-heard promise 'we will find out what works and what does not' scarcely does justice to the complexity of medical practice," the Stanford professor wrote.

• Steep declines in choice and quality. This is all of a piece with the hubris of an Administration that thinks it can substitute government planning for market forces in determining where the $33 trillion the U.S. will spend on medicine over the next decade should go.

This centralized system means above all fewer choices; what works for the political class must work for everyone. With formerly private insurers converted into public utilities, for instance, they'll inevitably be banned from selling products like health savings accounts that encourage more cost-conscious decisions.

Unnoticed by the press corps, the Congressional Budget Office argued recently that the Senate bill would so "substantially reduce flexibility in terms of the types, prices, and number of private sellers of health insurance" that companies like WellPoint might need to "be considered part of the federal budget."

With so large a chunk of the economy and medical practice itself in Washington's hands, quality will decline. Ultimately, "our capacity to innovate and develop new therapies would suffer most of all," as Harvard Medical School Dean Jeffrey Flier recently wrote in our pages. Take the $2 billion annual tax—rising to $3 billion in 2018—that will be leveled against medical device makers, among the most innovative U.S. industries. Democrats believe that more advanced health technologies like MRI machines and drug-coated stents are driving costs too high, though patients and their physicians might disagree.

"The Senate isn't hearing those of us who are closest to the patient and work in the system every day," Brent Eastman, the chairman of the American College of Surgeons, said in a statement for his organization and 18 other speciality societies opposing ObamaCare. For no other reason than ideological animus, doctor-owned hospitals will face harsh new limits on their growth and who they're allowed to treat. Physician Hospitals of America says that ObamaCare will "destroy over 200 of America's best and safest hospitals."

• Blowing up the federal fisc. Even though Medicare's unfunded liabilities are already about 2.6 times larger than the entire U.S. economy in 2008, Democrats are crowing that ObamaCare will cost "only" $871 billion over the next decade while fantastically reducing the deficit by $132 billion, according to CBO.

Yet some 98% of the total cost comes after 2014—remind us why there must absolutely be a vote this week—and most of the taxes start in 2010. That includes the payroll tax increase for individuals earning more than $200,000 that rose to 0.9 from 0.5 percentage points in Mr. Reid's final machinations. Job creation, here we come.

Other deceptions include a new entitlement for long-term care that starts collecting premiums tomorrow but doesn't start paying benefits until late in the decade. But the worst is not accounting for a formula that automatically slashes Medicare payments to doctors by 21.5% next year and deeper after that. Everyone knows the payment cuts won't happen but they remain in the bill to make the cost look lower. The American Medical Association's priority was eliminating this "sustainable growth rate" but all they got in return for their year of ObamaCare cheerleading was a two-month patch snuck into the defense bill that passed over the weekend.

The truth is that no one really knows how much ObamaCare will cost because its assumptions on paper are so unrealistic. To hide the cost increases created by other parts of the bill and transfer them onto the federal balance sheet, the Senate sets up government-run "exchanges" that will subsidize insurance for those earning up to 400% of the poverty level, or $96,000 for a family of four in 2016. Supposedly they would only be offered to those whose employers don't provide insurance or work for small businesses.

As Eugene Steuerle of the left-leaning Urban Institute points out, this system would treat two workers with the same total compensation—whatever the mix of cash wages and benefits—very differently. Under the Senate bill, someone who earned $42,000 would get $5,749 from the current tax exclusion for employer-sponsored coverage but $12,750 in the exchange. A worker making $60,000 would get $8,310 in the exchanges but only $3,758 in the current system.

For this reason Mr. Steuerle concludes that the Senate bill is not just a new health system but also "a new welfare and tax system" that will warp the labor market. Given the incentives of these two-tier subsidies, employers with large numbers of lower-wage workers like Wal-Mart may well convert them into "contractors" or do more outsourcing. As more and more people flood into "free" health care, taxpayer costs will explode.

• Political intimidation. The experts who have pointed out such complications have been ignored or dismissed as "ideologues" by the White House. Those parts of the health-care industry that couldn't be bribed outright, like Big Pharma, were coerced into acceding to this agenda. The White House was able to, er, persuade the likes of the AMA and the hospital lobbies because the federal government will control 55% of total U.S. health spending under ObamaCare, according to the Administration's own Medicare actuaries.

Others got hush money, namely Nebraska's Ben Nelson. Even liberal Governors have been howling for months about ObamaCare's unfunded spending mandates: Other budget priorities like education will be crowded out when about 21% of the U.S. population is on Medicaid, the joint state-federal program intended for the poor. Nebraska Governor Dave Heineman calculates that ObamaCare will result in $2.5 billion in new costs for his state that "will be passed on to citizens through direct or indirect taxes and fees," as he put it in a letter to his state's junior Senator.

So in addition to abortion restrictions, Mr. Nelson won the concession that Congress will pay for 100% of Nebraska Medicaid expansions into perpetuity. His capitulation ought to cost him his political career, but more to the point, what about the other states that don't have a Senator who's the 60th vote for ObamaCare?

"After a nearly century-long struggle we are on the cusp of making health-care reform a reality in the United States of America," Mr. Obama said on Saturday. He's forced to claim the mandate of "history" because he can't claim the mandate of voters. Some 51% of the public is now opposed, according to National Journal's composite of all health polling. The more people know about ObamaCare, the more unpopular it becomes.

The tragedy is that Mr. Obama inherited a consensus that the health-care status quo needs serious reform, and a popular President might have crafted a durable compromise that blended the best ideas from both parties. A more honest and more thoughtful approach might have even done some good. But as Mr. Obama suggested, the Democratic old guard sees this plan as the culmination of 20th-century liberalism.

So instead we have this vast expansion of federal control. Never in our memory has so unpopular a bill been on the verge of passing Congress, never has social and economic legislation of this magnitude been forced through on a purely partisan vote, and never has a party exhibited more sheer political willfulness that is reckless even for Washington or had more warning about the consequences of its actions.

These 60 Democrats are creating a future of epic increases in spending, taxes and command-and-control regulation, in which bureaucracy trumps innovation and transfer payments are more important than private investment and individual decisions. In short, the Obama Democrats have chosen change nobody believes in—outside of themselves—and when it passes America will be paying for it for decades to come.

Passing health reform could be a nightmare for Obama

Barack Obama's quest for historic health-care legislation has turned into a parody of leadership. We usually associate presidential leadership with the pursuit of goals that, though initially unpopular, serve America's long-term interests. Obama has reversed this. He's championing increasingly unpopular legislation that threatens the country's long-term interests. "This isn't about me," he likes to say, "I have great health insurance." But of course, it is about him: about the legacy he covets as the president who achieved "universal" health insurance. He'll be disappointed.

Even if Congress passes legislation -- a good bet -- the finished product will fall far short of Obama's extravagant promises. It will not cover everyone. It will not control costs. It will worsen the budget outlook. It will lead to higher taxes. It will disrupt how, or whether, companies provide insurance for their workers. As the real-life (as opposed to rhetorical) consequences unfold, they will rebut Obama's claim that he has "solved" the health-care problem. His reputation will suffer.

It already has. Despite Obama's eloquence and command of the airwaves, public suspicions are rising. In April, 57 percent of Americans approved of his "handling of health care" and 29 percent disapproved, reports the Post-ABC News poll; in the latest survey, 44 percent approved and 53 percent disapproved. About half worried that their care would deteriorate and that health costs would rise.

These fears are well-grounded. The various health-care proposals represent atrocious legislation. To be sure, they would provide insurance to 30 million or more Americans by 2019. People would enjoy more security. But even these gains must be qualified. Some of the newly insured will get healthier, but how many and by how much is unclear. The uninsured now receive 50 to 70 percent as much care as the insured. The administration argues that today's system has massive waste. If so, greater participation in the waste by the newly insured may not make them much better off.

The remaining uninsured may also exceed estimates. Under the Senate bill, they would total 24 million in 2019, reckons Richard Foster, chief actuary of the Centers for Medicare & Medicaid Services. But a wild card is immigration. From 1999 to 2008, about 60 percent of the increase in the uninsured occurred among Hispanics. That was related to immigrants and their children (many American-born). Most illegal immigrants aren't covered by Obama's proposal. If we don't curb immigration of the poor and unskilled -- people who can't afford insurance -- Obama's program will be less effective and more expensive than estimated. Hardly anyone mentions immigrants' impact, because it seems insensitive.

Meanwhile, the health-care proposals would impose substantial costs. Remember: The country already faces huge increases in federal spending and taxes or deficits because an aging population will receive more Social Security and Medicare. Projections the Congressional Budget Office made in 2007 suggested that federal spending might rise almost 50 percent by 2030 as a share of the economy (gross domestic product). Since that estimate, the recession and massive deficits have further bloated the national debt.

Obama's plan might add almost an additional $1 trillion in spending over a decade -- and more later. Even if this is fully covered, as Obama contends, by higher taxes and cuts in Medicare reimbursements, this revenue could have been used to cut the existing deficits. But the odds are that the new spending isn't fully covered, because Congress might reverse some Medicare reductions before they take effect. Projected savings seem "unrealistic," says Foster. Similarly, the legislation creates a voluntary long-term care insurance program that's supposedly paid by private premiums. Foster suspects it's "unsustainable," suggesting a need for big federal subsidies.

Obama's overhaul would also change how private firms insure workers. Perhaps 18 million workers could lose coverage and 16 million gain it, as companies adapt to new regulations and subsidies, estimates the Lewin Group, a consulting firm. Private insurers argue that premiums in the individual and small-group markets, where many workers would end up, might rise an extra 25 to 50 percent over a decade. The administration and the CBO disagree. The dispute underlines the bills' immense uncertainties. As for cost control, even generous estimates have health spending growing faster than the economy. Changing that is the first imperative of sensible policy.

So Obama's plan amounts to this: partial coverage of the uninsured; modest improvements (possibly) in their health; sizable budgetary costs worsening a bleak outlook; significant, unpredictable changes in insurance markets; weak spending control. This is a bad bargain. Health benefits are overstated, long-term economic costs understated. The country would be the worse for this legislation's passage. What it's become is an exercise in political symbolism: Obama's self-indulgent crusade to seize the liberal holy grail of "universal coverage." What it's not is leadership.

Leadership, Obama Style, and the Looming Losses in 2010: Pretty Speeches, Compromised Values, and the Quest for the Lowest Common Denominator

As the president's job performance numbers and ratings on his handling of virtually every domestic issue have fallen below 50 percent, the Democratic base has become demoralized, and Independents have gone from his source of strength to his Achilles Heel, it's time to reflect on why. The conventional wisdom from the White House is those "pesky leftists" -- those bloggers and Vermont Governors and Senators who keep wanting real health reform, real financial reform, immigration reform not preceded by a year or two of raids that leave children without parents, and all the other changes we were supposed to believe in.

Somehow the president has managed to turn a base of new and progressive voters he himself energized like no one else could in 2008 into the likely stay-at-home voters of 2010, souring an entire generation of young people to the political process. It isn't hard for them to see that the winners seem to be the same no matter who the voters select (Wall Street, big oil, big Pharma, the insurance industry). In fact, the president's leadership style, combined with the Democratic Congress's penchant for making its sausage in public and producing new and usually more tasteless recipes every day, has had a very high toll far from the left: smack in the center of the political spectrum.

What's costing the president and courting danger for Democrats in 2010 isn't a question of left or right, because the president has accomplished the remarkable feat of both demoralizing the base and completely turning off voters in the center. If this were an ideological issue, that would not be the case. He would be holding either the middle or the left, not losing both.

What's costing the president are three things: a laissez faire style of leadership that appears weak and removed to everyday Americans, a failure to articulate and defend any coherent ideological position on virtually anything, and a widespread perception that he cares more about special interests like bank, credit card, oil and coal, and health and pharmaceutical companies than he does about the people they are shafting.

The problem is not that his record is being distorted. It's that all three have more than a grain of truth. And I say this not as one of those pesky "leftists." I say this as someone who has spent much of the last three years studying what moves voters in the middle, the Undecideds who will hear whichever side speaks to them with moral clarity.

Leadership, Obama Style

Consider the president's leadership style, which has now become clear: deliver a moving speech, move on, and when push comes to shove, leave it to others to decide what to do if there's a conflict, because if there's a conflict, he doesn't want to be anywhere near it.

Health care is a paradigm case. When the president went to speak to the Democrats last week on Capitol Hill, he exhorted them to pass the bill. According to reports, though, he didn't mention the two issues in the way of doing that, the efforts of Senators like Ben Nelson to use this as an opportunity to turn back the clock on abortion by 25 years, and the efforts of conservative and industry-owned Democrats to eliminate any competition for the insurance companies that pay their campaign bills. He simply ignored both controversies and exhorted.

Leadership means heading into the eye of the storm and bringing the vessel of state home safely, not going as far inland as you can because it's uncomfortable on the high seas. This president has a particular aversion to battling back gusting winds from his starboard side (the right, for the nautically challenged) and tends to give in to them. He just can't tolerate conflict, and the result is that he refuses to lead.

We have seen the same pattern of pretty speeches followed by empty exhortations on issue after issue. The president has, on more than one occasion, gone to Wall Street or called in its titans (who have often just ignored him and failed to show up) to exhort them to be nice to the people they're foreclosing at record rates, yet he has done virtually nothing for those people. His key program for preventing foreclosures is helping 4 percent of those "lucky" enough to get into it, not the 75 percent he promised, and many of the others are having their homes auctioned out from right under them because of some provisions in the fine print. One in four homeowners is under water and one in six is in danger of foreclosure. Why we're giving money to banks instead of two-year loans -- using the model of student loans -- to homeowners to pay their mortgages (on which they don't have to pay interest or principal for two years, while requiring their banks to renegotiate their interest rates in return for saving the banks from "toxic assets") is something the average person doesn't understand. And frankly, I don't understand it, either. I thought I voted Democratic in the last election.

Same with the credit card companies. Great speech about the fine print. Then the rates tripled.

The president has exhorted the banks, who are getting zero-interest money, to give more of it to small businesses. But they have no incentives to do that. There are too many high-yield, reasonably low risk investments to make with zero-interest federal loans. I wouldn't mind a few billion to play around with right now myself, and I can't say I'd start with some guy who wants to start his own heating and air company, or an existing small business owner who is hanging on by his fingernails in tough economic times. I'd put my money in something like emerging markets, or maybe Canada. (Have you noticed how well Canadian equities are doing lately?) Or perhaps Chinese wind turbines. (Oh, we're investing there already with stimulus funds.)

The time for exhortation is over. FDR didn't exhort robber barons to stem the redistribution of wealth from working Americans to the upper 1 percent, and neither did his fifth cousin Teddy. Both men told the most powerful men in the United States that they weren't going to rip off the American people any more, and they backed up their words with actions. Teddy Roosevelt was clear that capital gains taxes should be high relative to income taxes because we should reward work, not "gambling in stocks." This President just doesn't have the stomach to make anyone do anything they don't want to do (except women to have unwanted babies because they can't afford an abortion or live in a red state and don't have an employer who offers insurance), and his advisors are enabling his most troubling character flaw, his conflict-avoidance.

Like most Americans I talk to, when I see the president on television, I now change the channel the same way I did with Bush. With Bush, I couldn't stand his speeches because I knew he meant what he said. I knew he was going to follow through with one ignorant, dangerous, or misguided policy after another. With Obama, I can't stand them because I realize he doesn't mean what he says -- or if he does, he just doesn't have the fire in his belly to follow through. He can't seem to muster the passion to fight for any of what he believes in, whatever that is. He'd make a great queen -- his ceremonial addresses are magnificent -- but he prefers to fly Air Force One at 60,000 feet and "stay above the fray."

It's the job of the president to be in the fray. It's his job to lead us out of it, not to run from it. It's his job to make the tough decisions and draw lines in the sand. But Obama really doesn't seem to want to get involved in the contentious decisions. They're so, you know, contentious. He wants us all to get along. Better to leave the fights to the Democrats in Congress since they're so good at them. He's like an amateur boxer who got a coupon for a half day of training with Angelo Dundee after being inspired by the tapes of Mohammed Ali. He got "float like a butterfly" in the morning but never made it to "sting like a bee."

Do you think Americans ought to have one choice of health insurance plans the insurance companies don't control, or don't you? I don't want to hear that it would sort of, kind of, maybe be your preference, all other things being equal. Do you think we ought to use health care as a Trojan Horse for right-wing abortion policies? Say something, for God's sake.

He doesn't need a chief of staff. He needs someone to shake him until he feels something strongly enough not just to talk about it but to act. He's increasingly appearing to the public, and particularly to swing voters, like Dukakis without the administrative skill. And although he is likely to squeak by with a personal victory in 2012 if the economy improves by then, he may well do so with a Republican Congress. But then I suppose he'll get the bipartisanship he always wanted.

No Vision, No Message

The second problem relates to the first. The president just doesn't want to enunciate a progressive vision of where this country should be heading in the 21st century, particularly a progressive vision of government and its relation to business. He doesn't want to ruffle what he believes to be the feathers of the American people, to offer them a coherent, emotionally resonant, values-driven message -- starting with an alternative to Ronald Reagan's message that government is the problem and not the solution -- and to see if they might actually follow him.

He doesn't want to talk about social issues, even though they predictably have gotten in the way of health care reform and will do the same on one issue after another. Abortion? You don't advance a progressive position by giving a center-right speech at Notre Dame that emphasizes cutting back on the number of abortions without mentioning that sex education and birth control might be useful means to that end, mumbling something about a conscience clause that suggests that pharmacists don't have to fill birth control prescriptions if it offends their sensibilities, and allowing states to use health care reform to set back the rights of women and couples to decide when to start their families based on somebody else's faith. If you believe that freedom includes the freedom to decide when you will or won't have a child, say it, say it with moral conviction, and follow it up with action. Perhaps something as simple as this: "I won't sign a health bill into law that forces women and couples to have a child they did not intend and are not ready to parent because of the dictates of someone else's faith or conscience." You know what? A message of that sort wins by 25 points nationally, and you can speak it in Southern and win with evangelical Christians in the deep south if you speak to them honestly in the language of faith. That shouldn't be hard for a president who is a religious Christian.

Gays? Virtually all Americans are for repealing don't ask/don't tell (except for conservatives who haven't yet come to terms with their own homosexuality -- but don't tell them that, or at least don't ask). This one's a no-brainer. Tell Congress you want a bill on your desk by January 1, and announce that you have serious questions about the constitutionality of the current policy and won't enforce it until your Justice Department has had time to study it. Don't keep firing gay Arabic interpreters. But that would require not just giving the pretty speech on how we're all equal in the eyes of God and we should all be equal in the eyes of the law (a phrase he might want to try sometime). It would require actually doing something that might anger a small percentage of the population on the right, and that's just too hard for this president to do. It's one thing to acknowledge and respect the positions of people who hold different points of view. It's another to capitulate to them.

Immigration? Joe Wilson yells, "You lie." So instead of acting like a man and going after Wilson on the spot (the man just attacked him in front of the entire nation in a joint session of Congress), he accepts his apology the next day, and a day later rewards Wilson for his incivility and bigotry by tightening the rules so that illegal immigrants can't even buy insurance themselves on the health care exchange the Democrats are creating sometime between 2013 and 2025 (depending on how many seats they lose in the meantime, and hence how long, if ever, it takes for the exchange to get set up).

Nasty charges of bribery. Senators cut off mid-speech. Accusations of politics put over patriotism. Talk of double-crosses. A nonagenarian forced out after midnight for multiple procedural votes.In the heart of the holiday season, Senate Republicans and Democrats are at one another’s throats as the health care overhaul reaches its climactic votes, one of which is set for 1 a.m. Monday. A year that began with hopes of new post-partisanship has indeed produced change: Things have gotten worse.

Well, yes they have. How did we get to this point? Well, for starters, Obama, who ran on his determination to transcend partisan divisions, remained a passive and aloof figure when it came to the drafting and the details, allowing partisan passions to run wild. His sole concern was winning, not building a broad-based coalition for revolutionary legislation. Indeed, he contributed to partisan furies by labeling opponents as confused and misinformed and by repeating a series of partisan and baseless accusations against Republicans (the principal one — that they had “no alternative” — was easily disproved by the plethora of conservative plans and proposals). Obama had a reason for proceeding in this way — he wanted to rely on the muscle of large Democratic majorities to obtain the most liberal bill he could get. On Sunday John McCain explained:

There’s been a change. It’s more partisan. It’s more bitterly divided than it’s been. I have never been asked to engage in a single serious negotiation on any issue, nor has any other Republican. Now they’ve brought single Republicans down to try to pick off one or two Republicans so you can call it, quote, bipartisan. There’s never been serious across-the-table negotiations on any serious issue that I have engaged in with — I and others have engaged in with other administrations, both Republican and Democrat.


And if comity and Obama’s own credibility were sacrificed along the way, well, that’s simply what a Chicago pol must do to win.

It’s not a pretty picture, as even the Times must concede:

On Sunday, Republicans did not mince words when characterizing provisions put in the health care bill to attract the final votes for passage, particularly that of Senator Ben Nelson, Democrat of Nebraska. Some suggested that special Nebraska considerations in the bill amounted to bribery and corruption. Senator Lindsey Graham, Republican of South Carolina, said on CNN’s “State of the Union” that it was reflective of “seedy Chicago politics.”

“In order to try to get the 60 votes, there has been basically a pay to play approach to this, and it’s just repulsive,” [Sen. John] Cornyn said.

Now some say that bipartisanship is overrated. But Obama wasn’t one of them. He got himself elected, in large part, because he promised to rise about the naked partisanship that had alienated so many voters. No Blue and Red States, just the United States of America and all that. So the question remains whether having jettisoned that tone and approach to politics, the president and his party will face any consequences. It’s not hard to imagine that once the dreamy idealism of young voters, the optimism of independents (who had grown disgusted with politics as normal), and the self-delusion of some Republicans (convinced that Obama was a man of reason, not of bare-knuckle politics) are drained away, the Democrats will face a motivation deficit in 2010 and perhaps beyond.

Having adopted the worst qualities of his hyper-partisan predecessors, Obama has left the “outsider” and “change” message by the wayside. We’ll see if his opponents are savvy enough to grab it and run for daylight.

In my own personal struggle with all this, I’m beginning to wonder what -- if any -– choices Obama has had so far. And how different things would really be had he made another one.

Though I am hardly a member of the “he-inherited-a-mess” crowd, he did inherit three wars. He could have cut and run out of all three, or stayed. He chose to stay.

He also “inherited” the economy (though so does every President). He could have taken some of the most shocking measures in arguably all of American history, or he could have done nothing. He chose to take the shocking measures.

Healthcare reform was a campaign promise. A major one. He could have pushed through a shoddy bill, or he could have done nothing. He chose to push through a shoddy bill.

Gay rights and similar social issues were also campaign promises. He could have done nothing, or pushed through more shoddy legislation and caused more rioting in the streets. He chose to do nothing.

Flip any of those answers, and tell me if they really would have had been the better choice. Don’t get me wrong. I could have done without the arrogance, the disconnect, the global warming summits and Olympic bids, the gowns Michelle wore while Rome burned. The disappointment in Obama is not just “about the economy stupid”, as the half-witted Monica Crowly suggested to Imus this morning. There are a lot of reasons right now to be concerned about this President. But it hasn’t even been a year. I keep thinking to myself: President Bush hit his prime on September 12th, 2001, and it was downhill from there. If all that’s left to Obama is the upswing, maybe there’s no reason for all this despair. Unless the amassing critics are right, that what we’re seeing right now is exactly what we’re going to get. Maybe it all really was too good to be true. But I’m still willing to give the guy a chance.

It surprises --- and disturbs --- me that I find myself agreeing with Racehorse on so many matters of late. Of course, our agreement is merely an indication of how diametric opposites tend to meet: I despise Obama for being a fascist-appeaser, while Racehorse despises him for not being an open fascist. Oh well...

There will be no true health care reform in Amerika unless and until our Congressmen begin to lose control over their bowels when they realize that they might be burned alive in the House and Senate chambers within an hour unless they do something fast...

Yeah, it's at this point now...

Look for House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid to try to circumvent the traditional conference committee process by which the different versions of health care reform passed by each house will be reconciled. If so, it will be the latest example of violating principles of transparency and accountability in the single-minded pursuit of legislative victory.

Conferences involving members from both houses are messy things. They are usually conducted in public and often televised, and can produce a compromise version of the bill that leaves rank-and-file members tempted to vote against the final version. That could be perilous in the case of health care since it's likely to pass without a vote to spare in the Senate and the House's version passed by only five votes.

North Dakota Senator Kent Conrad, chair of the Budget Committee, has already warned that if the final bill "isn't close to the Senate bill, there will be no way to get the 60 votes here" to shut off debate and pass the final product. But many House members, led by Michigan Rep. John Conyers, are insisting on major changes in the Senate's version.

Mr. Reid and Ms. Pelosi would love to come up with a way to bash heads in private and skip any public discussion that further reveals just how incoherent and unworkable both the bills are. Luckily, there is a subterfuge readily available that wouldn't require the House to swallow the Senate's bill unchanged but also ducks the traditional give-and-take of the conference committee.

When Democrats took over Congress in 2007, they increasingly did not send bills through the regular conference process. "We have to defer to the bigger picture," explained Rep. Henry Waxman of California. So the children's health insurance bill passed by the House that year was largely dumped in favor of the Senate's version. House Ways and Means Chairman Charles Rangel and other Democrats complained the House had been "cut off at the knees" but ultimately supported the bill. Legislation on lobbying reform and the 2007 energy bill were handled the same way -- without appointing an actual conference.

Rather than appoint members to a public conference committee, those measures were "ping-ponged" -- i.e. changes to reconcile the two versions were transmitted by messenger between the two houses as the final product was crafted behind closed doors solely by the leadership. Many Democrats grumbled at the secrecy. "We need to get back to the point where we use conference committees . . . and have serious dialogue," said Rep. Artur Davis of Alabama at the time.

But serious dialogue isn't what Speaker Pelosi and Majority Leader Reid are interested in right now. Look for the traditional conference committee to be replaced by a "ping-pong" game in which health care is finalized behind closed doors with little public scrutiny before the bill is rushed to the floor of each chamber for a final vote.
