I am not sure which of the below stories is more alarming. National Security Presidential Directive 51 (NSPD-51) authorizes Bush - in the event of a "catastrophic emergency" - to do whatever he deems necessary to ensure "continuity of government." This could include everything from canceling elections to suspending the Constitution to launching a nuclear attack. Hmm, are these the "potential war crimes" that Bush & co. are shielding themselves from? But if the last story has any validity, there won't be any need to detain millions of sheople – I mean people.

Rule by fear or rule by law?

"But the real question is: What kind of "new programs" require the construction and refurbishment of detention facilities in nearly every state of the union with the capacity to house perhaps millions of people?"
